Terms And Conditions


I, the Cardholder acknowledge that I have read the terms and conditions of this agreement (“ARABEX Application Agreement”), that I understand that these terms and conditions shall govern the Service offered by CSC Jordan (hereafter referred to as “CSC”) and I hereby explicitly agree to be bound by such terms and conditions, in addition to the general terms of CSC governing the Card Account which terms apply to the Service unless otherwise mentioned herein.


1. Definitions:

  • “APP PIN”: shall mean the four digits’ security code chosen by the Cardholder and used to unlock the Application.
  • “Card Information” shall mean the Card Account related information that are scanned or filled out manually by the Cardholder using the Application, including but not limited to the primary account number (the “PAN’) and the Card’s expiry date.
  • “Card Account”: Shall mean the Card account of the Cardholder at CSC.
  • “Card Association” shall mean Card Brand.
  • “Cardholder Data” shall mean the Card Information, the Cardholder’s related data as well as the Card Account data whether such data is received, processed, transferred, disclosed, gathered and/or shared as a result of the enrolment in and/or the use of the Service.
  • “Card”: shall mean any representation of the payment Card linked to the Card Account.
  • “Application” and/or “App”: Shall mean the mobile software application that is downloaded on the Cardholder’s Mobile Device for the use of the Service.
  • “Service”: shall mean the service offered by CSC to CSC’s Cardholders through the App and which service enables such Cardholders to use their mobile device (the “Mobile Device”) to carry out any of the App Activities.
  • “App Activity”: Shall mean any of the following activities offered by CSC to the Cardholders through the App regarding such Cardholders’ Card Accounts that are enrolled in the Service:
    • i) View the Card Information;
    • ii) Check the available credit and used balance of the Card Account;
    • iii) View the transactions posted on the Card Account during the previous twelve months period;
    • iv) Modify a user profile;
    • v) Change APP PIN;
    • vi) Track the Cardholder’s log in history;
    • vii) Track the Cardholder’s spending habits;
    • viii) Send feedbacks;
    • ix) View frequently asked questions;
    • x) View the App related terms and conditions;
    • xi) View the Cardholder’s protection documents;
    • xii) Request e-statements for a specific time frame; and
    • xiii) any other type of activity made available by CSC at any time.
  • “Mobile Number”: Shall mean the GSM mobile number as provided by the Cardholder to CSC and available in CSC’s database for the designated Card. This mobile number shall be used by CSC for the App and to receive the OTP required for the enrolment in the Service.
  • “OTP”: Shall mean the one time password generated by CSC and sent to the Cardholder’s Mobile Number, and that is required for the enrolment in the Service It should be noted however that in case of resetting the APP PIN, the needed OTP shall only be sent to the Cardholder’s email address. (the Cardholder’s email address shall be the email address provided by the Cardholder to CSC and available in CSC’s database for the designated Card.)

2. Terms and Conditions:

  • 2.1 The Cardholder hereby agrees and acknowledges at the Cardholder’s full risk and liability, that the Cardholder is personally the legal owner or is authorized by the legal owner of the Mobile Device as well as of the Mobile Number that are provided for the purposes of registration to and use of the Service, and the Cardholder hereby instructs CSC (i) to use the Mobile Number for all aspects of the Service; and (ii) to enable the Cardholder to use the Mobile Device to create the user profile and to carry out the App Activities.
  • 2.2 The Cardholder authorizes CSC, at the Cardholder’s full risk and liability, to debit the Card Account for all amounts, charges and fees pertaining to the Cardholder’s enrolment and/or use of the Service, if applicable.
  • 2.3 Once the Application is downloaded onto the Cardholder’s Mobile Device, the Cardholder shall be required to enter the Cardholder’s Card Information or to scan the Cardholder’s Card using the Mobile Device’s camera through the Application.
  • 2.4 Thereafter, the Cardholder shall automatically receive an OTP from CSC in order to insert the OTP received from CSC and create the User Profile on the Cardholder’s Mobile Device (the “User Profile”). Such OTP shall be sent by means of an SMS (or an email in the event of resetting the APP PIN) and shall have a validity period to be determined solely by CSC, which validity period shall be transmitted to the Cardholder along with the OTP.
  • 2.5 The Cardholder shall select an APP PIN to unlock the App. The APP PIN shall be numerical noting however that, the Cardholder may opt to use another App security feature to login to the App by activating biometric login and/or pattern code as supported by the Application. Furthermore, should the authentication method based APP PIN opted for by the Cardholder not function for any reason, then the Cardholder shall use the numerical APP PIN to unlock the Application. Additionally, it is to be noted that the Cardholder shall be requested to provide a recovery email to be used to reset the APP PIN.
  • 2.6 Once the enrolment to the Service is successfully completed, the Cardholder shall be entitled to use the App to carry out any App Activity so long as the Card is valid and so long as the Application is duly available on the Cardholder’s Mobile Device.
  • 2.7 The Cardholder shall be directly and personally liable for all amounts, charges and expenses incurred on the Application and/or as a result of any App Activity.
  • 2.8 The Cardholder is responsible to protect and safeguard his/her Mobile Device and APP PIN and shall exercise all possible care to ensure the safety of the Mobile Device and of the APP PIN and to prevent their misuse.
  • 2.9 The Cardholder agrees not to write down or record the APP PIN in an unsecure place in order to avoid any third party coming across same, and the Cardholder shall hold CSC harmless for any App Activity unauthorized by the Cardholder and made through the User Profile and/or using the App and/or using the APP PIN. The Cardholder shall further exempt CSC from any form of liability whatsoever for complying with any instruction given through of the Cardholder’s User Profile where the Cardholder’s Mobile Device, or any other device, used to access the Service was in the possession of any third party and/or the APP PIN becomes known to such third party and the Mobile Device was used to carry out App Activities.
  • 2.10 In the event of loss or theft of the Mobile Device, the Cardholder must immediately notify CSC of such loss or theft by telephone. Failure to do so will hold the Cardholder liable for any App Activity carried out through the User Profile using the App.
  • 2.11 The User Profile shall be enabled to carry out App Activities in accordance with the maximum daily or periodical parameters set by CSC per Cardholder noting that such parameters may be amended according to the related Card Association and/or CSC sole discretion.
  • 2.12 The Cardholder shall be directly and personally responsible for each App Activity undertaken on the Cardholder’s User Profile including without limitation those carried out through the User Profile using the App by any third party. The Cardholder is solely responsible to safeguard at all times access to the Mobile Device, to the APP PIN, and any other access to the User Profile, and the Cardholder agrees to honour every App Activity carried out using the User Profile through the App.
  • 2.13 All App Activities made using the User Profile through the App, whether by or with the consent of the Cardholder or not, are final. The Cardholder will be liable for any App Activity carried out using the User Profile through the App and CSC has no responsibility whatsoever for any unauthorized use of the User Profile.
  • 2.15 The Cardholder understands that the Card as well as the User Profile hosted on the Mobile Device is used to give instructions to CSC pertaining to the Service as well as to the App Activities in the name of the Cardholder and further understands and agrees that the use of the App as well as carrying out any App Activity shall be considered as a substitute for the Cardholder’s signature and shall be deemed valid and binding on the Cardholder noting that the use of the User Profile or the App shall be sufficient confirmation of the authenticity of the instruction given. The Cardholder hereby instructs and authorizes CSC to comply with any instructions given to CSC through the use of the App and the User Profile. Any App Activity carried out using the User Profile hosted on the Mobile Device shall be charged to the Card Account (where applicable) and the Cardholder shall be liable for all such App Activity including any related fees (where applicable). Furthermore, each App Activity correctly processed using the Cardholder’s User Profile shall be considered final and cannot be revoked or contested.
  • 2.16 The Cardholder shall hold CSC harmless from any App Activity carried out using the User Profile through the App and unauthorized by the Cardholder. The Cardholder shall further exempt CSC from any form of liability whatsoever for complying with any instruction given by means of the Cardholder’s Mobile Device, or any other device, used to access the User Profile on the Application used to carry out App Activities.
  • 2.17 Once the Cardholder is enabled to dispute a transaction using the APP, then the Cardholder should follow the dispute procedure adopted by CSC for requests carried out on the Application as communicated to the Cardholder at the time of dispute. Any dispute initiated after the permitted time period cannot be taken into consideration by CSC nor accepted for processing. 2.18 Should the Cardholder wish to change the Mobile Device, then the Cardholder shall be responsible
  • 2.18 Should the Cardholder wish to change the Mobile Device, then the Cardholder shall be responsible to delete the App from his old device and download and include his Card Information on his new Mobile Device, and the Cardholder shall provide CSC with any form and document requested by CSC to enable CSC to carry out the necessary changes to the Cardholder’s User Profile on ARABEX Application (where required), noting that the Cardholder shall remain liable for any App Activity that takes place using the User Profile so long as such User Profile and the related Card Account are valid and not cancelled.
  • 2.19 If the Cardholder wishes CSC to stop the Service on the Mobile Device, for any reason, then the Cardholder shall be responsible to uninstall the App from his Mobile Device and delete the Cardholder User Profile.
  • 2.20 The Cardholder acknowledges that CSC reserves the right, unilaterally and with immediate effect at any time and from time to time, temporarily or permanently, in whole or in part, and without having to justify its measures, to: modify, suspend or discontinue the Service; charge fees in connection with the use of the Service; modify and/or waive any fees charged in connection with the Service; and/or offer opportunities to some or all Cardholders of the Service. The Cardholder agrees that neither CSC nor any of its affiliates shall be liable to the Cardholder or to any third party for any modification, suspension or discontinuance of the Service, in whole or in part, or of any service, content or feature offered through the Service.
  • 2.21 CSC may, at its sole discretion, set the requirements and terms of the App functionalities and App Activities, and may set maximum daily or periodical parameters per Cardholder.
  • 2.22 Under no circumstances will CSC be liable for any damages, including without limitation direct or indirect, special, incidental or consequential damages, losses or expenses arising in connection with the Service or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation, transmission, computer or mobile virus or line or system failure, even if CSC or its representatives thereof are advised of the possibility of such damages, losses. CSC hereby specifically disclaims any liability with regard to the App Activities carried out using the App and the Service.
  • 2.23 CSC makes no warranty that:
    • a- the Service will meet the Cardholder requirements; and
    • b- The Service will be uninterrupted, timely, or error-free
  • 2.24 The Cardholder hereby acknowledges that the Service availability may be subject to:
    • a- Availability of a mobile device capable of receiving SMS;
    • b- Geographic and technical capability of the mobile networks and delivery systems of the respective mobile service providers at the time and location when the Service is requested or delivered;
    • c- Geographic and technical capability of the email and delivery systems of the respective internet service providers at the time and location when the Service is requested or delivered; and
    • d- Any terms and conditions imposed by the respective mobile service providers.
  • 2.25 Additional terms pertaining to the Application:
    • a- The Application (including any content made available through the Application) are the property of CSC (or its licensors) and are protected by applicable intellectual property laws. The App is licensed, not sold, to the Cardholder. The Cardholder may utilize the Application only as permitted by ARABEX Application Agreement. The Cardholder may not, and will not permit any other party to: (1) modify, adapt, alter, translate or create derivative works of the Application; (2) use or merge the Application, or any component or element thereof, with other software, databases or services not provided by CSC; (3) sublicense, distribute, sell or otherwise transfer the Application to any third party; (4) use the App as a service bureau, or lease, rent or loan the App to any third party; (5) reverse engineer, decompile, disassemble or otherwise attempt to derive the source code or structure of the Application; (6) interfere in any manner with the operation of the Application; (7) circumvent, or attempt to circumvent, any electronic protection measures in place to regulate or control access to the Application; (8) create a database by systematically downloading and storing the Application; (9) use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or in any way gather the Application or reproduce or circumvent the navigational structure or presentation of the Application without CSC’s (and its licensors) express prior written consent; or (10) use the Application for any commercial purposes. The Cardholder agrees not to develop, distribute or sell any software or other functionality capable of launching, being launched from or otherwise integrated with the Application. The Cardholder may not remove, alter or obscure any copyright notice or any other proprietary notice that appears on or in the Application.
    • b- The Cardholder agrees and acknowledges that CSC is relieved of any liability in regards to breach of duty of secrecy arising out of the Cardholder’s inability to scrupulously observe and implement the provisions of these terms of use, and/or instances of breach of such duty by hackers and other unauthorized access to the Cardholder’s Card Account via the Service.
    • c- The Cardholder agrees and acknowledges that CSC shall not be responsible for any electronic virus or viruses that the Cardholder may encounter in course of making use of the Application.
    • d- Any material downloaded or otherwise obtained through the use of the Service is done at the Cardholder’s own discretion and risk and CSC is not responsible for any damage to the Cardholder’s Mobile Device system on which the Application is downloaded or for any loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by the Cardholder from CSC or through or from the Service will create any warranty not expressly stated in these terms.
    • e- The Cardholder acknowledges full awareness of, accepts, and bears the consequences of the risks resulting from the use of the Service. Accordingly, in addition to the above, CSC shall bear no responsibility either from misuse or as a result of fraudulent use of the Service.

3. Privacy:

  • 3.1 By enrolling and/or using the Service, the Cardholder hereby accepts the privacy terms as described herein and consents to the disclosure, transfer, processing, sharing and/or use of Cardholder Data by CSC for the purpose of providing such Cardholder with the Service.
  • 3.2 The Cardholder hereby further acknowledges and accepts that CSC shall have the right to lawfully process and collect the related Cardholder Data as may be required in order to, without limitation: (i) provide the Service; (ii) verify the Cardholders’ identity and carry out the Cardholders’ due diligence; (iii) comply with the applicable laws and regulations relating to the prevention of money laundering and terrorist financing and issue the criminal report(s) to which CSC is legally bound; (iv) process the App Activities carried out through the App using the Service; and (v) conduct internal assessment and analysis.
  • 3.3 The Cardholder hereby irrevocably waives his/her right to invoke the Secrecy terms as set forth in the applicable laws (including- without limitation- the secrecy terms under the Electronic Payment and Transfer of Money Regulation Number 111 Year 2017 or any amendment thereto or replacement legislation) against CSC, and the Cardholder further accept and authorizes CSC to disclose any Cardholder Data to any party CSC may deem appropriate, regarding matters related to the Service and/or any App Activity executed or to be executed through the Service.

4. General Additional Terms:

The following additional terms shall apply:

  • 4.1 CSC shall not be considered an agent or other legal representative of the Cardholder for any purpose by reason of ARABEX Application Agreement. CSC and the Cardholder shall be independent contractors, and nothing contained in the ARABEX Application Agreement shall be deemed to create any association, partnership, joint venture between the parties.
  • 4.2 ARABEX Application Agreement is personal to the Cardholder and the Cardholder may not assign it to anyone.
  • 4.3 CSC does not grant or transfer to the Cardholder any intellectual property rights pertaining to the Service. The Cardholder acknowledges and agrees that CSC (or its licensors) owns all rights to the Service and that the Cardholder is only permitted to use the Service as expressly authorized by CSC.
  • 4.4 The Cardholder hereby acknowledges and accepts that he/she shall be automatically enrolled in CSC’s SMS alert service and that he/she will receive SMS alerts on the Mobile Number relating to the Service.
  • 4.5 CSC reserves the right to amend these terms and conditions at any time. The Cardholder shall be notified accordingly of these amendments. Continued use of the Service constitutes acceptance by the Cardholder of such amendments. The Cardholder hereby acknowledges that from time to time and as the laws change, certain additional information will be required by CSC to remain in compliance and be able to perform properly its duties in its relationship with the Cardholder. As such, the Cardholder hereby undertakes to provide any information ort sign any requested document as required by CSC in order to complete or update its files or otherwise comply with its legal obligations as per the applicable rules and regulations.
